Software License Agreement

Summary: WhatsHub is proprietary software provided as a service (SaaS). You get a license to use it — you do not own it. Your data remains yours.
1. License Grant
JI Wentzel Trading ("Company", "we", "us") grants you a limited, non-exclusive, non-transferable, revocable license to access and use the WhatsHub platform ("Software") through our hosted service at whatshubb.co.za, subject to these terms.
1.1 What You Can Do
- Use WhatsHub tools through the web interface for personal or business purposes
- Connect your own WhatsApp account to use the platform's features
- Export your own data at any time
- Use free tools without a subscription
- Access Pro tools with an active paid subscription
1.2 What You Cannot Do
- Copy, modify, decompile, reverse-engineer, or disassemble the Software
- Redistribute, sublicense, sell, or lease the Software to any third party
- Remove or alter any proprietary notices, labels, or marks
- Use the Software to build a competing product or service
- Attempt to gain unauthorised access to other users' accounts or data
- Use automated tools (bots, scrapers) to access the platform without written permission
- Use the Software for any unlawful purpose, including spam or harassment
2. Intellectual Property
All rights, title, and interest in the Software — including source code, design, features, documentation, and branding — are and remain the exclusive property of JI Wentzel Trading. This license does not grant you any ownership rights.
The WhatsHub name, logo, and visual identity are trademarks of JI Wentzel Trading. You may not use them without prior written consent.
3. Your Data
You retain full ownership of any data you create, upload, or generate through the platform. We do not claim any intellectual property rights over your content.
We store your data solely to provide the service. See our Privacy Policy for details on how we handle your information.
4. Subscriptions and Payment
- Free Tier: Basic tools are available at no cost, with no time limit
- Pro Tier: Advanced tools require an active monthly subscription (currently R49/month)
- Pricing may change with 30 days' notice to active subscribers
- Subscriptions are billed monthly and may be cancelled at any time
- No refunds are provided for partial months
5. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted service. WhatsHub depends on third-party services (including WhatsApp) that are outside our control.
We reserve the right to perform maintenance, updates, or modifications to the Software at any time. We will provide reasonable notice for planned downtime where possible.
6. Limitation of Liability
To the maximum extent permitted by South African law:
- The Software is provided "as is" without warranties of any kind, express or implied
- We are not liable for any indirect, incidental, special, or consequential damages
- Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
- We are not responsible for any actions taken by WhatsApp (Meta Platforms) regarding your WhatsApp account
7. WhatsApp Disclaimer
WhatsHub is an independent product and is not affiliated with, endorsed by, or sponsored by WhatsApp Inc. or Meta Platforms, Inc. WhatsApp is a registered trademark of WhatsApp LLC.
Use of WhatsHub with your WhatsApp account is at your own risk. We do not guarantee compatibility with future WhatsApp updates or policies.
8. Termination
- You may stop using WhatsHub at any time by closing your account
- We may suspend or terminate your access if you violate these terms
- Upon termination, your license to use the Software ends immediately
- We will make your data available for export for 30 days after account closure
9. Governing Law
This agreement is governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the courts of South Africa.
This agreement complies with the Consumer Protection Act 68 of 2008, the Electronic Communications and Transactions Act 25 of 2002, and the Protection of Personal Information Act 4 of 2013 (POPIA).
10. Changes to This License
We may update this license agreement from time to time. Material changes will be communicated via email or in-app notification at least 14 days before taking effect. Continued use of the Software after changes constitutes acceptance.
